These Terms and Conditions is referred to all users of Web hosting services from AdriaHost and it has purpose of preventing illegal activities or eventual misuse on AdriaHost servers, respecting freedom of speech and expressing if it is not harmful for others, protecting integrity and privacy of users, as well as providing safety and reliability of network. By using Web hosting services through AdriaHost network, user accepts rules listed in Terms and Conditions, including not taking activities in this Terms and Conditions defined as unacceptable using of Web hosting services. AdriaHost guarantees its users 99.5% uptime (visibility of presentation). If users exceeds monthly limit of data transfer (bandwidth), each gigabyte over limit is charged 5€. Maximum monthly bandwidth for audio streaming accounts is 300 GB. If your account reaches this limit our sales department will contact you for additional price. AdriaHost is not liable for secrecy or privacy of data transferred via AdriaHost network, it is users liability to protect their data. User is personally liable for his/her account and eventual negative consequences arising from his/her behavior during utilization of Web hosting services with AdriaHost. Unacceptable, i.e. not allowed conduct during utilization of Web hosting service includes the following activities: · Transfer or presentation of any information, data or material opposing legal regulations RS, classified as criminal felony or economy offence, breaching provisions stipulated in authors rights and proprietary industry rights, act of disloyal competition, breaching good business customs and any other conduct opposing generally accepted moral principles; · Presentation of contents harmful for AdriaHost servers or any other server on the Internet, as well as putting links toward this type of content on the Internet. Example of unacceptable content: pirate software, hacking programs or archives, warez sites, irc; · Unauthorized access to contents of other users, changing content, deleting or any other modification of the content; · AdriaHost cannot be the source, mediator or recipient address related to transfer of undesired e-mails, e-mail bombs or other mass e-mails. Your account cannot be sending, mediator or recipient address for such e-mails. Mass e-mail is message sent to more than 1000 e-mail addresses or more than 10 news groups; · Users of content management system (PHP Nuke, Mambo, Joomla, etc) as well as other scripts on AdriaHost are liable for following up safety and protection issues for these systems and removing familiar vulnerabilities by regular maintenance and using patches and updates. · User presentation may not at any moment load CPU of our server more than 10%. If such event arises due to unoptimized Web application or base, the presentation shall be suspended until problem is solved. If this load is result of excessive site visitation, i.e. if your site exceeded hosting limitations, we will contact you and offer adequate hosting solution. Measures in the event of unacceptable conduct: AdriaHost will not actively follow up users operations to see if named respects Terms and Conditions. User of AdriaHost is responsible to cooperate with preventive and corrective activities conducted for purpose of breaching Terms and Conditions; Checking up users operations will be performed based on third party complaint, in which case the procedure is as follows: 1. In the event or complaint or unpaid liabilities, AdriaHost will send e-mail or contact user by telephone and instruct him/her to solve the problem. 2. In the event user is not responding timely or not being available, AdriaHost will suspend presentation (Web site) until problem is solved. 3. In the event of repetitive breaching of Terms and Conditions AdriaHost reserves the right to terminate providing Web hosting service without refund. 4. In the event of breaking the Law, AdriaHost will make available all relevant data and information to competitive bodies, if legally obliged. 5. In the event that users activities cause material damage to AdriaHost (penalties, system damage...) we reserve the right to charge double value of expenses or initiate legal process requesting claim. Measures in the event of sending and transferring spam: 1. Upon first complaint that user sent spam, AdriaHost will suspend account for period of 24 hours and contact user. 2. If incident repeats, second warning with 48 hours account suspension will follow. 3. Repetitive breaching of Terms and Conditions will result in account closing without refund. Reporting breaching Terms and Conditions AdriaHost will not self-initiatively control conducts of its users on the Internet; given it will mean breaching privacy rights. AdriaHost may change, modify or amend Terms and Conditions without prior notice. Application of Terms and Conditions is put into effect immediately upon displaying on AdriaHost presentation. |
